Privacy Policy
Please note: the German version of this privacy policy is the legally binding one. This English version is provided for ease of understanding only. If the two versions differ, the German version prevails.
This privacy policy explains how worksmart365 GmbH collects and processes personal data on worksmart365.ch and the associated subdomains (for example play.worksmart365.ch and academy.worksmart365.ch). The basis for this is the revised Swiss Data Protection Act (revDSG) and, where applicable, the EU General Data Protection Regulation (GDPR).

Hosting
This website is hosted on GitHub Pages, a service of GitHub Inc. (USA), a subsidiary of Microsoft Corporation. When the site is accessed, technical data is recorded in log files on the server (IP address, browser type, operating system, date and time of access, page requested). This data is necessary for the secure and stable delivery of the website. It involves a transfer to the USA. See the section «Transfer of data abroad».
Which data is collected?
- Server log files: as described above under «Hosting».
- Contact by email: if you write to us, we process the data you provide (name, email address, content of your message) solely in order to handle your enquiry. Email traffic runs via Microsoft 365 (Microsoft Ireland Operations Ltd. or Microsoft Corporation, USA).
- Appointment booking: a Calendly booking calendar can be loaded on the contact page. The calendar is only loaded once you actively click «Load booking calendar», before that there is no connection to Calendly. As soon as you load it, your browser establishes a connection to
calendly.com. In doing so, Calendly may record your IP address and browser information. If you book an appointment, the data you enter (name, email, preferred time) is transmitted to Calendly. Calendly is a service of Calendly LLC, USA, privacy policy at calendly.com/privacy. - Newsletter sign-up: a sign-up form can be loaded on the newsletter page and at the end of blog posts. The form is only loaded once you actively click «Load sign-up form», before that there is no connection to beehiiv. As soon as you load it, your browser establishes a connection to
beehiiv.com. In doing so, beehiiv may record your IP address and browser information. If you sign up, the data you enter (first name, email address) is transmitted to beehiiv and stored there. Sign-up uses the double opt-in procedure. It only takes effect once you confirm it via a confirmation link in your email. You can unsubscribe at any time via the unsubscribe link in every issue. beehiiv is a service of beehiiv Inc., USA, privacy policy at beehiiv.com/privacy. - Fonts: the «Inter» typeface is delivered from our own server and is not loaded from Google Fonts. Accessing the website therefore creates no connection to Google servers, and no IP address is transmitted to Google.
- Online calculators and self-service tools: the entries you make in our resources tools (for example the Modern Work Check, the licence and efficiency calculators) are processed exclusively locally in your browser. These entries are not transmitted to us or to any third party.
Cookies and analytics
On your first visit, we ask for your consent via a notice at the bottom of the screen. If you decline, no analytics tools are loaded.
If you consent, we load the following analytics services, depending on the website:
- Google Analytics 4 (measurement ID
G-5BD2ZY8HXY), embedded on worksmart365.ch via Google Tag Manager (container IDGTM-54D3NN55), and directly on play.worksmart365.ch. Google Analytics records anonymised usage data such as pages viewed, time spent on the site and approximate region of origin. IP addresses are truncated by Google before storage. Provider: Google Ireland Ltd., Dublin. Privacy policy: policies.google.com/privacy. - Microsoft Clarity (project ID
a995qkoqmp, on worksmart365.ch). Clarity produces anonymised heatmaps and session recordings in order to see how visitors use the site (where they click, scroll and go back). No form content, no passwords and no email addresses are recorded (masking active by default). Provider: Microsoft Ireland Operations Limited, Dublin. Privacy policy: privacy.microsoft.com. - Plausible Analytics (on academy.worksmart365.ch). Plausible records anonymised, aggregated usage statistics (for example pages viewed, approximate region of origin) without cookies and without combining data across websites. No personal data is stored. Hosted in the EU. Provider: Plausible Insights OÜ, Estonia. Privacy policy: plausible.io/privacy.
I use these services solely in order to understand which content really helps visitors. No advertising, no passing data on, no merging with other data sources.
Withdraw consent: click here to reset your choice. The next time you visit, the cookie banner will appear again and you can decide anew.
Disclosure of data
Data is passed on to third parties only where this is necessary in order to fulfil a contract, to handle an enquiry or because of legal obligations. Technical service providers (hosting, appointment booking, analytics) are selected carefully and, where required, contractually bound as processors.
Transfer of data abroad
Some of the services named above (GitHub Pages, Microsoft 365, Google, Calendly, beehiiv) may transfer personal data to the USA or to other countries outside Switzerland and the EEA. These transfers rely on recognised safeguards, in particular the EU standard contractual clauses and, where certified, the EU-US and Swiss-US Data Privacy Framework. A level of data protection equivalent to Swiss law cannot be guaranteed in every case in these countries.
No automated decision-making
There is no exclusively automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.
Your rights
You have the right to information, rectification, erasure, restriction of processing and data portability with regard to the data stored about you, as well as the right to withdraw consent you have given at any time. To do so, please contact fabrizio.marra@worksmart365.ch.
Supervisory authority
If you believe that the processing of your data breaches data protection law, you can lodge a complaint with the competent supervisory authority. In Switzerland this is the Federal Data Protection and Information Commissioner (FDPIC). Where the GDPR applies, you can contact the data protection authority of your EU place of residence or place of work.
Retention
We store personal data only for as long as is necessary for the respective purpose or for as long as legal retention obligations require.

This website contains links to external sites (for example LinkedIn, Microsoft documentation). The respective operators are solely responsible for the content published there and for how data is handled there.
Changes
We may amend this privacy policy at any time in order to align it with changes in the legal situation or with adjustments to our services. The version published on this page at any given time is the authoritative one.
